Occupier’s Consent

Any person over the age of 17 years old who will live at a property but will not own the property, will be asked to consent to the mortgage being taken out and agree to move out if the mortgagee takes possession due to the default of the mortgage.

Overriding Interest

A right or interest in registered land which is binding on the owner and third parties, even though the right may not be formally registered or recorded with the Land Registry.
